SOLAR PANEL INSTALLATION / DESIGN REVIEW COMMITTEE
GUIDELINES

The Board of Trustees / Design Review Committee hereby establish the following
Guidelines to be followed by Owners requesting the installation of solar panel systems on their home in Bear Hollow Village:

  • All solar panel installations must be done by a licensed solar panel system contractor.
  • All solar panel installations must be in full compliance with all Summit County / Park City Fire District codes/ rules / guidelines for solar systems.
  • All components of the solar panel system must be mounted on the roof area of the subject property; no parts of the system can be mounted on the ground.
  • Only Black colored non-reflective solar panels, brackets and mounting hardware are permitted to be used.
  • All solar panels must be mounted flush with the roof line – no angled installations.
  • Only the main areas of the property roof can have solar panels mounted on them, no breezeway, entry way or other smaller roof areas can have solar panels mounted on them.
  • No wiring, piping or any part of the solar system installation can encroach or infringe in any way on another Owners private property.
  • Owners requesting a solar panel installation must submit a detailed drawing of the project in accordance with the Design Review guidelines and must also identify the color of all materials, the installation contractors name and license number, showing all roof area, all areas where solar panels will be installed, all setbacks from edges, valleys, and on townhouse buildings the “center roof line” between units, clearly identifying all setback distances (18 inches) from edges, center lines, etc.
  • Owners adding a “net metering” configuration as part of their solar installation must identify if their existing meter needs replacement and ensure that there is no encroachment or infringement of any kind on any other property to connect to the new meter.
  • Townhouse Owners acknowledge their responsibility to share in future roof repair or replacement projects needed for their building when that becomes necessary.  Townhouse Owners who have solar panels and related components installed on their properties must record a document with the Summit County Recorders Office acknowledging their responsibility to remove all solar panel system components to facilitate roof repairs or roof replacement projects required for their building.  If just one of the Owners in a multi unit townhouse building has a solar panel system installed, that Owner shall be responsible for all costs to remove the system to facilitate roof repairs or replacement.  If more than one Owner in a townhouse building has a solar panel system, these Owners will each be responsible for the cost to remove their part of the system to facilitate roof repairs or replacement.  A template for the recording is provided by the HOA for this purpose and must be approved by the Board of Trustees.
  • An Owner requesting a solar panel installation on their home must first submit all the above required information to the Design Review Committee for review and approval.  Not providing all requested information will result in the delay or denial of the request.
  • These Guidelines are intended to supplement the Design Review guidelines established in the Bear Hollow Village governing documents.  These Guidelines do not create any new rights or change the Bear Hollow Village governing documents in any way.

 

PLEASE REFER TO AND USE THE CHECKLIST BELOW AS A GUIDE WHEN SUBMITTING YOUR REQUEST TO THE DESIGN REVIEW COMMITTEE.

CHECKLIST

PLEASE PROVIDE THE FOLLOWING INFORMATION FOR DRC REVIEW:

  1. NAME and LICENSE NUMBER of the solar system contractor doing your installation.
  1. DETAILED DRAWING of the project showing all roof area, all areas where solar panels will be installed, all setbacks from edges, valleys, and on Townhouse buildings the center roof line between units, clearly identifying all setback distances ( 18 inches) from edges, center lines, etc.
  1. Information identifying the COLOR of the solar panels and mounting hardware to be used.
  1. Provide a STATEMENT indicating if your existing meter needs to be replaced (or state NO the meter does not need to be replaced) and confirm there is no encroachment or infringement of any kind on any other property to connect the new meter; confirming that no portion of the solar system is mounted on the ground area of your property; confirm that all solar panels will be mounted flush with the roof line (no angled installations).

SUBMIT THE ABOVE INFORMATION TO THE DESIGN REVIEW COMMITTEE / TRUSTEES FOR REVIEW.

TOWNHOUSE OWNERS  - after review of the above information, if your project is going to be approved the Design Review Committee will notify you of a “conditional approval” of your project and request that you then submit a copy of the recorded document filed with the Summit County Recorders Office as outlined in the Guidelines.  ( TEMPLATE FOR RECORDING ATTACHED).

Upon receipt and review of that document a final approval will be granted.

DO NOT obtain or submit the recorded document until requested to do so.

NOTE -  the document recording requirement does not apply to single family
             detached homes applications.

COVENANT

___________________________ (referred to hereinafter as “Owner”), who is/are the record owner(s) of fee simple title to the above-referenced real property (referred to hereinafter as the “Property”), which is a townhome as shown by the official plat of Bear Hollow Village, according to the official plat thereof recorded in the Office of the Recorder of Summit County, Utah, hereby represent(s) and agree(s), in exchange for valuable consideration, the sufficiency and receipt of which are hereby acknowledged, as follows:

1.         Owner has caused solar energy panels and related system components (the “System”) to be installed on the Property or is the owner of the Property on which a System was previously installed.  Owner represents and warrants to the Bear Hollow Village Homeowners Association (the “Association”) and all of the members of the Association (the “Members”) that to the best of Owner’s knowledge, understanding and belief, such installation was performed and completed by a licensed installer in accordance with prevailing industry standards and practices.

2.         Owner represents and warrants to the Association and the Members that Owner has obtained all required and appropriate insurance coverages in connection with the System.  Owner further represents and warrants that Owner shall maintain all required and appropriate insurance coverages for as long as Owner is the owner of the Property.

3.         Owner acknowledges and agrees that Owner is and shall be responsible for any and all costs relating to or arising from the installation, operation, maintenance, repair, removal, or replacement of the System and any items, components or other systems related thereto.

4.         Owner agrees to indemnify, defend and hold harmless the Association and its Members from and against any and all expenses, charges, fees, costs, claims, causes of action, and damages of any nature whatsoever relating to or arising from the System.

5.         Owner acknowledges and agrees that when it becomes necessary to maintain, repair or replace the roof of the Property and the adjoining unit, Owner shall be solely responsible for any and all costs incurred to remove or replace the System to accommodate the roof maintenance, repairs or replacement. 

6.         This Covenant shall run with the Property and shall be binding upon all subsequent holders of title to the Property.
